Welcome to HUEVIA. The terms "we", "us", and "our" refer to ECOM OPTIMA LLC, doing business as HUEVIA. We operate this website and all related content, features, tools, and products (the "Services").
These Terms of Service ("Terms"), together with the policies referenced in them, set out your rights and responsibilities when using the Services. Please read them carefully — they include important provisions on warranty disclaimers and limitations of liability.
By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, don't use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
By using the Services you confirm that you are at least the age of majority in your state or country of residence.
To place an order you may need to provide your email, billing, payment, and shipping details. You warrant that everything you provide is accurate, current, and complete. You're responsible for keeping your account credentials confidential and for all activity under your account. Accounts may not be sold, transferred, or assigned.
SECTION 2 — OUR PRODUCTS
We work to display our products as accurately as possible, but colors and finish can appear differently depending on your screen, lighting, and device settings.
HUEVIA products are pH-reactive, meaning the final shade develops according to your individual skin and lip chemistry. Results naturally vary from person to person, and we do not guarantee any specific shade outcome.
Product descriptions, ingredients, packaging, and pricing may change at any time without notice. We may discontinue a product or limit quantities at our discretion.
SECTION 3 — COSMETIC USE, ALLERGIES, AND HEALTH DISCLAIMER
Our products are cosmetics intended for external use on the lips only.
Statements about our products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
Before first use, we recommend a patch test on a small area of skin. Discontinue use immediately and consult a healthcare professional if you experience irritation, swelling, or an allergic reaction. Review the full ingredient list before purchase if you have known sensitivities. Keep out of reach of children. Do not use on broken, irritated, or infected skin.
Any before-and-after images, testimonials, or customer results shown on the Services reflect individual experiences and are not a guarantee that you will achieve the same results.
SECTION 4 — ORDERS
Placing an order is an offer to purchase. We may accept or decline any order at our discretion. No order is accepted until we confirm it and process payment.
Please review your order before submitting it. Once accepted, we may not be able to accommodate changes or cancellations. All purchases are subject to our Refund Policy.
You confirm your purchases are for personal or household use, not for commercial resale or export.
SECTION 5 — PRICES, BILLING, AND SUBSCRIPTIONS
Prices, promotions, and discounts may change without notice. The price charged is the price in effect when the order is placed, as shown in your order confirmation. Prices exclude shipping, handling, and applicable taxes unless stated otherwise.
Where you purchase a subscription or recurring plan, you authorize us to charge your payment method on the stated schedule until you cancel. Cancellation instructions and billing frequency are disclosed at checkout. You may cancel at any time by contacting support; cancellation takes effect for future billing cycles.
You agree to keep your payment information accurate and up to date.
SECTION 6 — SHIPPING AND DELIVERY
Shipping terms, delivery estimates, and carrier responsibilities are set out in our Shipping Policy, which forms part of these Terms. Delivery windows are estimates only. Once an order is handed to the carrier, title and risk of loss pass to you.
SECTION 7 — INTELLECTUAL PROPERTY
All content on the Services — including the HUEVIA name and logo, text, graphics, photographs, video, and site design — is owned by ECOM OPTIMA LLC or its licensors and protected by intellectual property law.
You may use the Services for personal, non-commercial purposes only. Copying, scraping, republishing, or commercially exploiting our content without written permission is prohibited.
SECTION 8 — USER CONTENT AND FEEDBACK
If you submit reviews, photos, videos, testimonials, comments, or suggestions, you grant us a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, publish, distribute, and display that content for any purpose, including advertising and marketing, without compensation or further approval.
You warrant that any content you submit is yours to share, doesn't infringe anyone's rights, and doesn't contain unlawful or defamatory material. We may remove any user content at our discretion.
SECTION 9 — THIRD-PARTY TOOLS AND LINKS
We may provide access to third-party tools "as is" and "as available," without warranty. The Services may also link to third-party websites we don't control and aren't responsible for.

To the fullest extent permitted by law, ECOM OPTIMA LLC, its officers, employees, and affiliates will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order giving rise to the claim.
SECTION 16 — INDEMNIFICATION
You agree to indemnify and hold harmless ECOM OPTIMA LLC and its service providers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services.
SECTION 17 — SEVERABILITY
If any provision of these Terms is found unenforceable, that provision is severed and the remainder stays in full force.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles.
